In Symbiont Science Engineering and Construction, Inc., et al. v. Ground Improvement Services, Inc., et al. v. Geopier Foundation Company, Inc., et al., Civ. No. 22-4905 (RK)(JBD), Jeffrey Pollock represented non-party Denali Water Solutions, LLC. DWS sought to intervene for the limited purpose of accessing discovery related to construction defects at an anaerobic digestion and biogas production facility. Entrenched in separate state court litigation, DWS aimed to use this information to support its defenses. However, the U.S. District Court denied its motion to intervene, citing concerns of lack of direct legal interest in the federal case.
