In the case of Catherine Evans, Receiver, on Behalf of Certified Steel Stud Association, Inc., v. William A. Gardner, et al. (Ohio Court of Appeals, 12th Dist., Case Nos. CA2022-07-070, CA2022-07-071, decided February 27, 2023), Jeffrey M. Pollock represents William A. Gardner, a director of the Certified Steel Stud Association, Inc. (CSSA). This complex litigation involves a lawsuit brought by a court-appointed receiver (initially John J. Reister, later Ms. Evans) on behalf of CSSA against its directors. This alleged that they breached their fiduciary duties by mishandling a prior defamation action by rejecting settlement offers and opposing dismissal. This ultimately led to a $43 million judgment against CSSA. Currently, Jeffrey Pollock is defending Gardner in the ongoing discovery phase of this lawsuit.
