In James E. Cooke, Jr. v. Perry Phelps et al. (Civil Action No. 17-cv-00781-CFC), Jeffrey Pollock represented an inmate, James Cooke, Jr. Cooke sued the Commissioner of the Delaware Department of Corrections and the Warden of the James T. Vaughn Correctional Center, alleging denial of necessary medical treatment for chronic foot issues and claiming violations of the Eighth Amendment of the U.S. Constitution and Delaware Constitution. While the federal court granted the defendants' motion to dismiss the Eighth Amendment claim, it denied the motion to dismiss the Delaware constitutional claim as of its November 25, 2019 ruling.
