In Engel v. Scully & Scully, Inc., 279 F.R.D. 117 (S.D.N.Y. Sept. 14, 2011), Jeffrey Pollock represented the defendant, Scully & Scully, Inc., in a significant putative class action. The case centered on allegations that the retailer willfully violated the Fair and Accurate Credit Transactions Act (FACTA) by printing non-truncated credit card information on customer receipts. While achieving a partial dismissal of negligent violation claims due to lack of alleged actual damages, the court ultimately granted class certification for the willful FACTA claims, defining a class of thousands of customers.
