Jeffrey Pollock represented the Certified Steel Stud Association, Inc. and other defendants in Clarkwestern Dietrich Building Systems, L.L.C. v. Certified Steel Stud Association, Inc., (Case No. CA2016–05–098). The Ohio Court of Appeals ruled in favor of Pollock's clients, stating that even though Clarkwestern's products were deemed non-compliant by the CSSA, this did not harm overall competition in the market, which is necessary for an antitrust claim. Clarkwestern could still sell its products and CSSA certification was not mandatory for market participation.
