In Cerco Bridge Loans 6 LLC v. Gregg Schenker, et al., 23 Civ. 11093 (DEH), Cerco's lawsuit was characterized by numerous discovery disputes. Jeffrey Pollock, serving as counsel for Plaintiff Cerco, played a key role in various successful discovery motions throughout the proceedings. Through his representation, the Plaintiff achieved significant favorable rulings, including the Court's decision to deny Defendants' motion to compel the deposition of Matthew Lubart, Plaintiff's transactional counsel, in recognition that depositions of opposing counsel are disfavored in the Second Circuit. Additionally, the Plaintiff's motion for a protective order and to quash certain deposition topics was granted in part, limiting Defendants' ability to inquire into attorney-client communications which were deemed privileged.
