In Board of Trustees of the Freeholders and Commonality of the Town of Southampton v. Suffolk County of New York, 367 Fed.Appx. 234 (2d Cir. 2010), Jeffrey Pollock represented Southampton as the United States Court of Appeals for the Second Circuit reviewed a district court's dismissal of various claims. The original case concerned claims of nuisance, negligence, and violations of the Endangered Species Act. The appeal then focused on whether the district court was correct in accepting the defendant's expert testimony, particularly on how sand moves along the coast, over the plaintiffs' expert. The appeals court found that the district court had not made any errors and affirmed its decision.
